Is It Time to Rethink Mandatory WHS Policies in the HVAC+R Industry?

Let’s start with a statement we all agree on: safety matters. No one in the HVAC+R industry wants to see a technician injured on the job. But here’s the uncomfortable question we need to ask:

Are our current workplace health and safety (WHS) mandates helping—or hindering—the outcome we all want?

As someone who’s spent decades in this trade, I’ve seen the rise of safety culture in Australia, and the enormous improvements it's driven. But I’ve also watched how layers of red tape, duplication, and overly prescriptive WHS requirements have bogged down smart, capable technicians and contractors in ways that aren’t always practical—or effective.

So here’s a challenging thought: maybe it’s time to reassess whether rigid, government-mandated WHS policies are truly necessary in our sector, or whether we can achieve safer outcomes through more flexible, industry-led methods.

Let’s unpack the facts.


The Stats: Injuries Still Happen Despite Strict Rules

Australia has one of the most comprehensive WHS regimes in the world. Yet in 2022–23, the construction sector still accounted for over 16,600 serious injury claims, with an incidence rate of 17.2 per 1,000 workers—well above the national average of 10.7. HVAC+R techs fall squarely in this group.

We’re a trade that works on roofs, in tight spaces, with refrigerants and live electricity. Yet despite all the mandatory paperwork, over 60% of serious injuries and 76% of workplace fatalities still come from just six high-risk industries—including ours.

The kicker? The rate of serious claims has barely changed in a decade. So while we’ve piled on more regulation, the improvement has slowed. That’s what economists call diminishing returns.


WHS Mandates: Necessary Protection or Paperwork Overload?

WHS compliance in HVAC+R often requires:

  • Site-specific safety inductions (every site, even for the same task),
  • Safe Work Method Statements (SWMS) that can stretch into 30+ pages,
  • Toolbox talks, permits, certifications, and written procedures that often overlap or repeat.

Now, safety isn’t the problem—bureaucracy is.

When we spend more time on paperwork than practical risk management, we miss the point. I’ve personally witnessed:

  • Projects delayed because a tech couldn’t work until a spotter arrived—even for a solo-safe task.
  • Refrigeration work held up because a document listed a specific brand of clamp not available onsite.
  • Hours lost to reading SWMS documents that contain more legalese than relevant safety content.

None of this boosts safety. It boosts frustration, cost, and inefficiency.


What the Industry Is Really Saying

Industry bodies like Master Builders Australia and AIRAH have consistently flagged that a one-size-fits-all WHS model doesn’t fit our specialised trade.

They’ve said:

“Safety documentation is becoming more about ticking boxes than identifying real hazards.”
“Overly rigid rules shift focus away from actual risk mitigation.”

And many small HVAC+R contractors are left asking: Why does a two-hour rooftop fan change demand the same compliance as a high-rise building site?

We know how to manage our risks. We know what works in the field. So why are we still being governed by a framework that assumes we don’t?


There Is a Better Way

We don’t need to abandon safety. We need to modernise how we deliver it. Here are some realistic alternatives:

1. Industry-Led Codes and Self-Regulation

Let HVAC+R associations like AMCA Australia and AIRAH lead the way in setting safety standards that actually reflect the work we do. We don’t need more rules—we need better, trade-specific ones that get to the point.

2. Third-Party Certification and Audits

Certification schemes like ISO 45001 already exist and are used widely. Companies that invest in these systems prove they’re serious about safety—without having to fill in the same forms for every job.

3. Insurance Incentives

The workers’ comp system already rewards safe businesses with lower premiums. Poor safety = higher costs. Let the market do the motivating, rather than smothering every task in paperwork.

4. Internal Safety Programs

Many HVAC businesses already run their own safety systems—toolbox talks, risk assessments, site protocols. Give them the flexibility to build what works for their team, not just what ticks a government box.


So… Do We Still Need Mandatory WHS for HVAC+R?

Yes—but not the way it’s being done now.

Let’s move away from inflexible, process-heavy systems. Let’s empower HVAC+R professionals to take ownership of safety in ways that are efficient, tailored, and outcome-driven.

The current approach makes compliance the goal. But safety should be the goal.
